In 1998, appellant and the 1st respondent contested councillorship elections for Kalong Ward of Shendam Local Government Area of Plateau State. The 1st respondent was returned as duly elected.

Appellant, dissatisfied and filed a petition of the Plateau State Election Tribunal sitting in Jos and that was dismissed on the 12th February, 1999. Dissatisfied with decision, the appellant appealed to the Court of Appeal.
